Evesham rules worth knowing before a tree comes down

  • Curbside trees are generally the owner's responsibility. Evesham's Public Works FAQ says property owners are responsible for maintaining or removing curbside trees. The township removes a curbside tree when it is a public safety hazard, such as a dead or failing tree, during its seasonal removal periods.
  • Road Opening Permit. If you hire your own contractor to remove a dead curbside tree or one whose roots are damaging the sidewalk, the township says you must get a Road Opening Permit before the work.
  • Sidewalk shared service program. Evesham has offered a program where, if a curbside tree is lifting the sidewalk, the township removes the tree, stump and roots and the homeowner replaces the sidewalk at their own cost. Call Evesham Public Works to ask whether it applies.
  • Chapter 144, Tree Removal and Replacement. The ordinance allows homeowners to remove a small number of trees (fewer than four qualifying trees per acre within five years) without replacement. For a hazardous tree, it asks for written justification and photos plus documentation from a licensed tree expert or certified arborist.
